ClavaMetrics ("ClavaMetrics", "we", "the Service") is a sports management and performance analytics platform operated by Joaquín Reiris Olsen Boje, located at Luis Pérez Aguirre, Manzana E, Solar 22, Solymar, Ciudad de la Costa, Uruguay, contact email info@clavametrics.app.
By creating an account, purchasing a plan or using the Service, you (the "Customer", typically a club, team, federation or sports organization) accept these Terms & Conditions. If you contract on behalf of an organization, you represent that you are authorized to bind it.

Available features depend on the plan (Free, Basic, Professional, Full) and may change over time.
The Customer is responsible for keeping its credentials confidential and for all activity under its account. The Customer manages the staff users it invites and their permissions. You must notify us immediately of any unauthorized use.
The Service is offered on a per-category/team subscription basis, with prices published in the app. Payment and billing are processed through Paddle.com, which acts as Merchant of Record and authorized reseller; Paddle handles payment, applicable taxes and invoices. By purchasing, you also accept Paddle's buyer terms.
Subscriptions renew automatically at the end of each period (monthly or annual) to the payment method on file, until cancelled.
We may offer a free trial period. When it ends, if no paid plan is contracted, the account moves to the free plan with limited features. We reserve the right to modify or discontinue trials.
Refund requests are handled under Paddle's policy and applicable law. See our Refund Policy.
The Customer agrees not to: (a) use the Service for unlawful purposes; (b) upload data without the necessary authorizations; (c) attempt to breach security or access other customers' data; (d) resell or exploit the Service without authorization; (e) overload or interfere with the infrastructure.
The Customer retains ownership of the data it uploads, without prejudice to clause 10.1 on Methodological Content. Regarding personal data of players and third parties, the Customer acts as data controller and ClavaMetrics as data processor, processing such data solely to provide the Service, in accordance with our Privacy Policy. Processing is further governed by the data processing agreement applicable between the parties, which is mandatory and does not depend on a request by the Customer.
The Service may store health data (injuries, medical assessments, wellness) and data of minors (youth categories), which enjoy enhanced protection. The Customer is responsible for having an adequate legal basis to process such data and, where applicable, for obtaining the necessary consents and authorisations from players and, where they are minors, their parents or guardians. ClavaMetrics applies technical and organizational measures to protect it.
The Service, its software, design and trademarks are the property of ClavaMetrics or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service during the subscription term. Customer data remains the Customer's, except as set out in clause 10.1.
"Methodological Content" means the field drills and tasks, gym exercises, session and microcycle templates, and analysis dashboards and cards that a user creates within the Service, to the extent they contain no personal data of players or third parties.
The user who creates it retains ownership of their Methodological Content and grants the Customer a non-exclusive, royalty-free, worldwide and perpetual licence to use, reproduce and adapt it within its sporting activity. That licence survives the user leaving the Customer: the club does not lose access to anything created in its workspace. Where the Customer and the user have agreed otherwise in writing — for example in an employment or services contract — that agreement governs their internal relationship.
The Service lets each user download a copy of their own Methodological Content and bring it into another organisation that also uses the Service. That copy excludes by design player data: profiles, loads, RPE, wellness, GPS, availability, injuries, clinical records and medical documents, named individual plans, match reports and assessments, which belong to the Customer and stay in its workspace.
The Customer may switch that download off for its users in the Service settings; in that case its administrators can generate and hand over the copy. Every download is recorded in the Customer's audit log. Portability never authorises extracting players' personal data or using it outside the Customer acting as data controller (clauses 8 and 9).
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may perform maintenance and updates. Support levels depend on the plan.
The Service is provided "as is" and "as available". To the maximum extent permitted by law, ClavaMetrics is not liable for indirect, incidental or consequential damages, or lost profits. Load-monitoring and analytics tools support professional decision-making and do not constitute medical advice, diagnosis or injury prediction; clinical and sporting decisions are the responsibility of the Customer and its technical/medical staff. Our total liability is limited, to the extent permitted by law, to the amounts paid in the preceding 12 months.
We may suspend or terminate access for breaches of these Terms or non-payment. You may cancel at any time. After termination, your data may be retained or deleted per the Privacy Policy and applicable law.
We may update these Terms. We will notify material changes by reasonable means. Continued use of the Service implies acceptance of the current version.
These Terms are governed by the laws of Uruguay. Any dispute will be submitted to the courts of Montevideo, without prejudice to consumer rights recognized by law.
